1. Scope and Acceptance
These Terms and Conditions apply to the supply of products, parts, components, repairs, field service, technical support, maintenance, training and related services by Jack’s Hydraulic Services.
By requesting a quote, placing an order, engaging our services, accessing our website or otherwise dealing with us, you agree to these Terms unless we agree otherwise in writing.
These Terms apply to business customers and trade customers. Where any non-excludable law applies, including the Australian Consumer Law, these Terms are read subject to that law.
2. Quotes, Estimates and Orders
- Quotes are valid for the period stated in the quote. If no period is stated, the quote is valid for 30 days from the date of issue.
- Prices, lead times and availability may change if supplier pricing, freight, exchange rates, component availability or job requirements change.
- An order is accepted only when confirmed by Jack’s Hydraulic Services in writing or when we begin supplying the relevant products or services.
- Any customer purchase order terms do not override these Terms unless we expressly agree in writing.
- We may refuse, cancel or suspend an order where information is incomplete, payment is overdue, parts are unavailable, or the order cannot be fulfilled safely or lawfully.
3. Pricing, GST and Payment
- Unless stated otherwise, all prices are in Australian dollars.
- Prices are exclusive of GST unless stated otherwise.
- Freight, delivery, call-out fees, travel, accommodation, testing, certification, consumables and urgent procurement charges may be charged in addition to quoted prices where applicable.
- Payment terms are as stated on the quote, invoice or approved credit account.
- If no payment term is stated, payment is due before supply or on receipt of invoice, as determined by Jack’s Hydraulic Services.
- We may charge interest, debt recovery costs and reasonable legal costs on overdue amounts to the extent permitted by law.
4. Credit Accounts
Credit accounts are subject to approval and may be changed, suspended or withdrawn at our discretion. We may require payment upfront, part payment, a deposit, or settlement of overdue amounts before further supply.
You must notify us promptly if your business details, ownership, billing address or authorised ordering contacts change.
5. Delivery, Collection and Risk
- Delivery dates and lead times are estimates only unless expressly confirmed in writing as fixed dates.
- Risk in products passes to you on collection, delivery to your nominated location, or handover to a carrier, whichever occurs first.
- Title to products remains with Jack’s Hydraulic Services until payment has been received in full.
- You are responsible for checking delivered products promptly and notifying us of any visible damage, shortage or incorrect item within a reasonable time.
- We are not responsible for delays caused by suppliers, carriers, customs, weather, site access restrictions, incorrect customer information or events outside our reasonable control.
6. Products, Specifications and Availability
Product information, images, technical data, drawings, brochures and website content are provided for general information unless specifically confirmed for your application in writing.
- You are responsible for ensuring products are suitable for your equipment, system, environment and operating conditions unless we have expressly agreed to provide engineering design or specification services.
- Where products are supplied to customer specifications, drawings, part numbers or samples, you are responsible for the accuracy and suitability of that information.
- Equivalent or replacement products may differ from original components. We will advise where this is material and known to us.
- Special-order, custom-built, modified, assembled or non-stock items may not be returnable unless required by law.
7. Field Service, Repairs and Site Work
Field service, repairs, maintenance, inspections, testing and troubleshooting are supplied based on the information available at the time. Hydraulic systems can involve hidden faults, contamination, wear, pressure issues, installation problems or site conditions that are not visible until work begins.
- Additional labour, parts, testing, travel or specialist support may be required if the scope changes or further faults are identified.
- We may stop work if the site, equipment or working conditions are unsafe or if required information, isolation, access or approvals are not provided.
- Where we provide fault-finding or troubleshooting, outcomes may depend on the condition of the equipment, availability of parts and the accuracy of information supplied by you.
- Any estimated repair time is an estimate only unless expressly agreed in writing.
8. Customer Responsibilities
You must provide accurate information, safe access and reasonable cooperation so we can supply products and services properly.
- You must ensure equipment is safely isolated, cleaned where necessary and available for inspection or repair.
- You must provide site induction requirements, permits, safety rules and access instructions before attendance where applicable.
- You must ensure that any parts, fluids, samples or equipment supplied to us are safe to handle and not contaminated with hazardous substances unless disclosed in advance.
- You are responsible for operating and maintaining hydraulic equipment in accordance with manufacturer instructions, site procedures and applicable laws.
9. Returns, Cancellations and Restocking
Return requests must be made within a reasonable time and are subject to approval unless a return is required by law.
- Products must be unused, undamaged, in original packaging and in saleable condition unless the issue relates to a fault or other legal entitlement.
- Proof of purchase may be required.
- Special-order, custom, modified, assembled, electrical, hydraulic, opened, installed or non-stock products may not be accepted for change-of-mind return.
- Approved returns may be subject to supplier approval, freight charges, inspection fees and restocking fees.
- Cancelled orders may incur costs where procurement, manufacturing, labour, freight or supplier commitments have already commenced.
10. Warranties and Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any rights, guarantees, warranties or remedies that cannot be excluded under the Australian Consumer Law or other applicable laws.
Where permitted by law, our liability for a failure to comply with a consumer guarantee is limited, at our option, to:
- the replacement of the goods or supply of equivalent goods;
- the repair of the goods;
- the payment of the cost of replacing the goods or acquiring equivalent goods;
- the payment of the cost of having the goods repaired;
- the resupply of the services; or
- the payment of the cost of having the services supplied again.
Manufacturer warranties may apply to some products. Warranty coverage may be void or limited where failure is caused by incorrect installation, misuse, contamination, incorrect fluid, overloading, unauthorised modification, poor maintenance, abnormal operating conditions, or use outside manufacturer specifications.
11. Liability
To the maximum extent permitted by law, Jack’s Hydraulic Services is not liable for indirect, special or consequential loss, including loss of production, loss of revenue, loss of profit, downtime, delay costs, loss of opportunity or business interruption.
Our total liability arising out of or in connection with the supply of products or services is limited to the amount paid by you for the relevant products or services, except where such limitation is not permitted by law.
12. Intellectual Property
All intellectual property in our website content, technical documents, drawings, designs, procedures, reports, images, branding and materials remains owned by Jack’s Hydraulic Services or its licensors unless otherwise agreed in writing.
You may use supplied documents and materials only for the purpose for which they were provided. You must not reproduce, modify, distribute or commercially exploit them without written permission.
13. Privacy
We handle personal information in accordance with our Privacy Policy. By dealing with us, you acknowledge that we may collect, use and disclose personal information as described in that policy.
14. Website Use
Website content is provided for general information only and may change without notice. While we aim to keep information accurate and current, we do not guarantee that website content is complete, error-free or suitable for every application.
You must not misuse the website, interfere with its operation, attempt unauthorised access, upload malicious code, scrape content at scale, or use the website for unlawful purposes.
15. Delays and Force Majeure
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including supplier delays, transport disruption, industrial action, natural events, fire, flood, accident, equipment failure, cyber incident, government action, shortage of materials or labour, or site access restrictions.
16. Disputes
If a dispute arises, both parties must first attempt to resolve it in good faith by discussion between authorised representatives. This does not prevent either party from seeking urgent injunctive relief or taking steps to recover overdue debts.
17. Governing Law
These Terms are governed by the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland and the courts entitled to hear appeals from those courts.
18. Changes to these Terms
We may update these Terms from time to time. The latest version will be posted on the website with the effective date. The Terms that apply to a specific order are the Terms in effect at the time the order is accepted, unless otherwise agreed in writing.
